California Consumer Privacy Act (CCPA)

 

  1. Scope and Overview

 

Mias Fashion Mfg. Co., Inc. hereby adopt this California Job Applicant Privacy Notice (this “Notice”) pursuant to the California Consumer Privacy Act of 2018 (CCPA) as revised by the California Privacy Rights Act of 2023 (CPRA) and any terms defined in the CCPA shall have the same meaning when used in this Notice.  This Notice applies to all job applicant to Mias Fashion who are residents of the State of California (“You” or “Consumer”).

 

Mias Fashion is committed to protecting the privacy and security of Your personal data.  This Notice describes what You can expect when Mias Fashion and its subsidiaries, affiliates, and other related entities (collectively, “Mias Fashion”, “We” or “Us”) collect and process Your personal data when you apply for a position at Mias Fashion.

 

Mias Fashion will only process Your personal data in accordance with this Notice unless otherwise required by applicable law.  Mias Fashion will take necessary steps to ensure that personal data collected is adequate, relevant, not excessive, and processed for limited purposes.

 

  1. Collection of Personal Data

 

For purpose of this Notice, personal data means any information about an identifiable individual.  Personal data excludes anonymous or de-identified data that is not associated with a particular individual.  To carry out Mias Fashion’ activities and obligations as a potential employer, Mias Fashion may collect, store, and process the following categories of personal data for the purpose of administering the potential employment or contractual relationship with You:

 

a) Personal contact details such as name, title, addresses, telephone numbers, and email addresses;

b) Date of birth;

c) Gender (if provided);

d) Signature;

e) Employment and education history, including Your qualifications, prior poisons, employment references, employment termination, and right to work information;

f) Educational records such as grades, transcripts, and class lists;

g) Additional background information necessary pertaining to applied job position;

h) Emergency contact information;

i) Government identification numbers such as taxpayer identification number, passport number, driver’s license number, or other identification number;

j) Photograph or photocopies for identification purposes;

k) US Military status and rank (if applicable);

l) Criminal history declared by You, or discovered via pre-employment screening;

m) Physical, mental, health, disability, if voluntarily provided You (to seek reasonable accommodation);

n) Other personal details included in resume or cover letter or other materials You voluntarily furnished to Mias Fashion.

Mias Fashion will collect the majority of the personal data directly from You.  In limited circumstances, third parties may provide Your personal data to us, such as former employer(s), recruiters, recruiting platforms, professional references You provided to Mias Fashion, pre-employment screening services, educational institutions, governmental institutions (such as regulators or criminal record bureaus), credentialing and licensing organizations, publicly available sources such as Your social media profile, other sources as directed by You, or other applicable sources related to Your job application.

 

III.  Use of Personal Data

 

Mias Fashion will only process Your personal data where applicable law permits or requires it, including where the processing is necessary for Mias Fashion to evaluate You as a job applicant, where the processing is necessary to comply with applicable legal obligations that applies to Mias Fashion as Your potential employer, or to protect legitimate business interest of Mias Fashion, or with your consent where applicable law requires such consent.  Mias Fashion may process Your personal data for the following legitimate business purposes:

 

a) Conduct interviews;

b) Conduct pre-employment screening and background checks (e.g. criminal history);

c) Protect the rights, property, or safety of You, Mias Fashion, and other party (e.g. CCTV footage);

d) Assess Your working capacity;

e) Required by applicable law, regulation, or regulatory body;

 

If Mias Fashion needs to process Your personal data for other purposes, Mias Fashion will notify You and, if required by applicable law, seek Your consent.

 

  1. Data Sharing

 

Mias Fashion will only disclose Your personal data to third parties where required by applicable law or to our employees, contractors, designated agents, or third-party service providers who require such information to assist Mias Fashion with administrating potential employment with You, including third party service providers who provide services to Mias Fashion or on Mias Fashion’ behalf.  These third-party service providers may be located outside of the State of California.

 

Mias Fashion require all its third-party service providers, by written contract, to implement appropriate measures to protect Your personal data consistent with Mias Fashion’ policies.  Mias Fashion do not permit its third-party service providers to process Your personal data for their own purposes, and the permission is limited to the extent required to provide their services to Mias Fashion, and only to carry out the purpose for which Mias Fashion’ disclosed Your personal data to them.  Third party service providers are not permitted to use Your personal data for any other purpose and in any manner that would constitute a violation of any federal, state or local regulations.

 

  1. Data Retention

 

Except as otherwise permitted or required by applicable law or regulation, Mias Fashion will only retain Your personal data for as long as necessary to fulfill the purposes Mias Fashion collected it for, as required to satisfy any laws or regulations governed by various regulatory bodies, legal, accounting, or other reporting obligations, or as necessary to resolve disputes.  To determine the appropriate retention period for personal data, Mias Fashion will consider its statutory obligations, the amount, nature, and sensitivity of the personal data, the potential risk of farm from unauthorized use or disclosure of personal data, and whether Mias Fashion can achieve such purposes through other means.

 

At the end of the retention period, Mias Fashion will delete or anonymize Your personal data so that it can no longer be associated with You.  Mias Fashion may continue to use anonymous and de-identified data for any legitimate business purposes without further notice to You or Your consent.

 

  1. Rights to Know, Right to Delete and Right to Correct

 

It is important that Your personal data is accurate and current.  Please keep Your personal data updated if Your personal data changes during Your job application process.  By law, You may have the right to request access to, correct, and delete the personal data that Mias Fashion holds about You, subject to all applicable laws.

 

Mias Fashion may request specific information from You to confirm Your identity in order to process Your right to access, correct and delete Your personal data.  Applicable law may allow or require Mias Fashion to refuse to provide You with access to some or all of the personal data that Mias Fashion holds about You, or Mias Fashion may have destroyed, deleted, or made Your personal data anonymous accordance with Mias Fashion’ record retention obligations and practices.  If Mias Fashion cannot comply with Your request, Mias Fashion will inform You the reasons why, subject to any legal or regulatory restrictions.

 

VII.  Right to Limit Use and Disclosure of Sensitive Personal Information

 

As used herein, the “Sensitive Personal Information” has the same meaning as set forth in the CPRA Section 1798.140(ae).  Sensitive Personal Information does not include information that is publicly available. You have the right to request that Mias Fashion limit the use of Your sensitive personal information for specific purposes by contacting Mias Fashion in writing.

 

VIII.  Right to Opt Out

 

Mias Fashion does not sell personal data to any third party for monetary consideration.  However, sharing personal data with third party for purposes stated in this Notice may be considered “selling” under applicable laws.  Therefore, you may opt out from sharing personal data by contacting Mias Fashion in writing.

Please note, only you or someone legally authorized to act on your behalf may make a verifiable request related to Your personal data.  To designate an authorized agent, please submit appropriate designation letter with Your identifiable personal information and signature to Mias Fashion.  Please note, Mias Fashion cannot respond to Your request if Mias Fashion cannot verify Your identity or if Mias Fashion does not receive proper documentation supporting / evidencing authorization to make request on Your behalf.  Mias Fashion will only use Your identifiable personal information to verify the requestor’s identity or the requestor’s authority to make the request.

 

Please allow 45 days to respond your request.  If more time is needed, You will be notified in writing.

 

VII.  Future Updates

 

Mias Fashion urge You to check the terms of this Notice for periodic updates.  Mias Fashion reserves the right to amend this Notice in order to reflect its legal and business obligations.  In the event that any material or substantive changes are necessary, you will be notified by posting the updated Privacy Policy on Mias Fashion’ website.
